BOSTON (WHDH) — The attack on the U.S. consulate in Libya became a major issue on the campaign trail and the mother of a Navy Seal killed in the violence is voicing her anger that Mitt Romney is speaking about her son on the campaign trail.

“I met some remarkable people, one of whom was a former navy seal. I just learned a few days ago that he was one of the two former navy seals killed in Benghazi. It broke my heart,” Romney said to a crowd on the campaign trail.

Glen Doherty was one of four Americans killed in the September 11 attack on the U.S. consulate. …

“I don’t trust Romney. He shouldn’t make my son’s death part of his political agenda. It’s wrong to use these brave young men, who wanted freedom for all, to degrade Obama,” said Barbara Doherty, Glen’s mother.

The New Hampshire defendants, by and through undersigned counsel, hereby specially appear and move this Court pursuant to Federal Rules of Civil Procedure 12(b )( 5) and 12(b )(2)for an order dismissing plaintiffs’ action against them with prejudice. This motion is made on the grounds that this Court lacks personal jurisdiction over plaintiffs’ claims against the New Hampshire defendants and that plaintiffs have failed to properly serve the New Hampshire defendants.

Gee, there’s a surprise.

Indeed, the use of an alleged co-conspirator’s acts to establish venue is frowned upon in that the “Supreme Court has labeled the conspiracy doctrine in
the venue context as having ‘all the earmarks of a frivolous albeit ingenious attempt to expand [venue].”‘ In reNew Motor Vehicles Canadian Export, 307 F. Supp 2d 145, 158 (D.Me. 2004)(quoting Bankers Life Cas. Co. v. Holland, 346 U.S. 379, 384; 74 S.Ct. 145, 98 L.Ed. 106 (1953)).

Plaintiffs make no allegation that the New Hampshire defendants have committed any acts within the district. More critical is that plaintiffs have not
alleged that venue is appropriate in this district. Furthermore, plaintiffs have asserted no specific grounds under which the New Hampshire defendants
participated in a multidistrict conspiracy. Again a mere allegation that New Hampshire should have somehow done more with regard to identification documents does not constitute sufficient grounds to establish a nationwide conspiracy. See e.g. Butchers Union. 788 F.2d at 539. Plaintiffs’ vague allegations against New Hampshire defendants cannot be sufficient to drag the state defendants thousands of miles outside of New Hampshire and bear the cost of defending an action that has already been adjudicated in New Hampshire.

Plaintiffs, to include among others, Attorney Orley Taitz and three New Hampshire representatives, bring an action against a hodgepodge of parties alleging an assortment of various claims. The mishmash of claims arise out of a belief that President Obama is not a natural born citizen of the United State and allege a multitude of wrongdoing to include fraud, conspiracy, defamation, etc.

Plaintiffs include vaguely defined claims against the New Hampshire Secretary of State and the New Hampshire Ballot Law Commission (BLC) which allege fraud, complicity and negligence. See First Amended Complaint, (~~40, 174 -189).1

And that’s the nicer stuff she’s said about them.

… this assistant Sec of State, Attorney General, Sec of State and 5 appointee puppets on the committee are nothing but lying traitorous scum, which will be standing trial for fraud, forgery and treason. As a reminder, penalty for treason- is life in prison or death penalty. That what all of them deserve together with Obama, Pelosi, Onaka, Fuddy and a few corrupt judges.

Hawaii GOP State Senate Candidate May Be A ‘Birther’

Republican Larry Fenton, who is running against Democratic Sen. Brian Taniguchi for the reapportioned District 11 seat on Oahu, says he served summons Monday (Oct. 8) that accuse state employees of “aiding and abetting President Obama in fraudulently obtaining ballot access through false and altered documentation.”

Papers were served for Alvin T. Onaka and Loretta Fuddy at the Hawaii DOH, Lt. Gov. Brian Schatz, the Attorney General’s Office and for Lynne Matusow at Democrat Party Headquarters.

Excerpt from Fenton’s release:

In Judd v. Obama, a case filed in US District Court, Central District of California, Southern Division, the complaint alleges that Defendant Onaka, Registrar of the State of Hawaii, aided and abetted Obama and was complicit in the cover up of the fact that Obama is using a forged birth certificate from the state of Hawaii. Onaka refused to provide an original birth certificate or original microfilm for examination. Also defendant’s Brian Schatz and Lynne Matusow are alleged to have aided and abetted fraud committed by Obama when they signed an altered/falsified Official Certification Of Nomination form from the Hawaii Department of Elections and removed the necessary wording “eligible according to the US Constitution” from the document in 2008.

President Obama was introduced at a Monday fundraiser by an old grade school classmate from the Punahou School in Honolulu, Hawaii.

Pam Hamamoto, who first met Obama as a young boy, said she had no inkling he would one day grow up to be the president of the United States.

“I still remember the first time I saw him on the playground when a classmate pointed at him and asked me, ‘Do you know Barry? Because he’s a new kid too,’” Hamamoto said at a fundraiser in San Francisco. “And I so I looked at him and I remember, I must confess, that it didn’t cross my mind at the time that this young boy with bare feet and chubby cheeks would grow up to be president of the United States.”

Hamamoto — who now lives in the San Francisco Bay area — last held a fundraiser for Obama in 2007, during his first bid for the presidency.

Hamamoto said that Obama derived his values from his time in the Aloha State.

President Obama leads Mitt Romney in Gallup’s daily tracking poll, after the GOP presidential nominee got an initial boost following his strong debate performance last week.

The economic news released Friday, showing the unemployment rate dipping to 7.8%, appears to have helped Obama.

“Romney definitely improved in Friday and Saturday polling among registered voters, but Obama did better Saturday and Sunday nights,” says Jeffrey Jones of Gallup.

The president now leads, 50% to 45%, among registered voters in the seven-day rolling average for Oct. 1-7, according to Gallup.

In polling conducted for two nights after the Denver debate on Oct. 3, Romney was able to pull even with Obama among registered voters. But Obama did better over the weekend, after the jobless rate dipped below 8% for the first time since January 2009.

According to Pew, they are tied, 46% to 46%.

So who knows?
