It Might Be Easier To Defend Ted Bundy

Dr. Orly Taitz, Esq. is appealing the $20,000 pop she took from Judge Clay D. Land of the Columbus Division of the Middle District of Georgia, in Rhodes v. MacDonald. Something must have got into her, because she hired an honest to God lawyer and the appeal brief seems to have been written by a sane person.

Appellant’s Plaintiff brought a case or controversy based on the interpretation of the “natural citizenship clause” of Article II, Section 1, Clause 4 of the United States Constitution. The District Court found the underlying case to be frivolous under Rule 11 and ordered Appellant to file no further frivolous actions in that court or face further Rule 11 sanctions. Appellant was not afforded an opportunity to respond to the initial finding that the underlying case was frivolous under Rule 11 hence the Motion for Reconsideration which resulted in an order of monetary sanctions under Rule 11 and an Order to Show Cause. When Appellant challenged this improper procedure with a Motion to Recuse, a third Rule 11 order was entered with no opportunity tor respond from which Appellant now appeals.

(I linked in the documents referenced above, not Orly’s attorney, Jonathan Levy, so no foul to him for any errors I may have made.)

Levy argues that Taitz did not receive due process, the District Court did not adhere to Rule 11 procedures, when she was not given time to respond to the sanctions. That’s not how I remember it. She was given the time she needed, from September 18 to October 13, to Show Cause why she shouldn’t be sanctioned and, instead, defiantly, filed a Motion to Reconsider and a Motion to Recuse the judge, in the most inflammatory and contemptuous terms imaginable.

As one of the legal brains at Politijab put it:

How do you defend an attorney against a sanctions order who called the judge a traitor and accused him of conspiring to overthrow the government based on the sighting of a short black man with a mustache in a coffee shop? It might be easier to defend Ted Bundy.

Welcome to Birfistan, Jonathan Levy. Time will only tell if you are half crazy enough for this crowd.
